Action in the Stearns County District Court for death by wrongful act brought by Claudia K. Majerus as trustee for the next of kin of Emil William Majerus whose death allegedly resulted from a fall on a stairway on premises owned by defendant, Tillie M. Guelsow. The case was tried before Byron R. Wilson, Judge, and a jury. On the basis of the jurys findings in a special verdict, the court ordered judgment for plaintiff for $7,500. Defendant appealed from the judgment entered and from an order denying her alternative motion for judgment notwithstanding the verdict or for a new trial. Her insurer, Standard Accident Insurance Company, sought to join in the appeal.
